1. Agreement to These Terms

These Terms of Service (“Terms”) govern your use of antwerpdiamondstore.com and any valuation request, chat conversation, or text message program offered through it, operated by Antwerp Diamonds LLC (“Antwerp Diamonds,” “we,” “us,” or “our”).

By using this website or submitting a valuation request, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

2. Eligibility

You must be at least 18 years old to use this website, request a valuation, sell an item to us, or enter into a loan transaction with us. We do not transact with minors.

3. What This Website Does

Antwerp Diamonds purchases luxury watches, fine jewelry, designer handbags, diamonds, and precious metals. This website lets you describe an item, upload photographs, and request a preliminary valuation from our team.

4. Valuations Are Not Offers

This is important, so please read it carefully.

Any figure, range, estimate, or indication of value we provide online, by chat, by text, or by phone is a preliminary estimate only. It is based entirely on the description and photographs you provide, and on market conditions at that moment.

A preliminary estimate is not an offer, is not binding on us, and does not create any obligation for either of us. We cannot authenticate an item, assess its true condition, or confirm its specifications from photographs alone.

A binding offer is made only after we physically inspect and authenticate the item in person at one of our offices, or after we receive it through our insured shipping process. A final offer may be higher than, lower than, or the same as any preliminary estimate, and we may decline to make an offer at all.

You are never obligated to sell. Precious metals prices move constantly, and any figure tied to a spot price is valid only for the moment it is given.

5. Your Responsibilities

By submitting a valuation request or presenting an item to us, you represent and warrant that:

You are the lawful owner of the item, or you are authorized in writing by the lawful owner to sell it
The item is not stolen, and is not subject to any lien, security interest, loan, or other claim
The item is not the subject of an open insurance claim
The information and photographs you provide are accurate and depict the actual item
You are not acting on behalf of any sanctioned person or entity
You will present valid government-issued identification at the time of any transaction

You are responsible for the accuracy of everything you tell us. If information you provide turns out to be false, we may void a transaction and we may be legally required to report it.

6. Authentication and Suspect Items

We authenticate every item before purchase. If we determine that an item is counterfeit, has been altered, has had identifying marks removed, or is reported stolen, we will decline the transaction. In some cases the law requires us to hold the item and notify law enforcement. We will not return an item to you if doing so would violate the law.

We are a dealer in precious metals, gemstones, and secondhand goods. In several jurisdictions we are legally required to verify your identity, record the transaction, hold items for a waiting period, and report transaction details to state or local law enforcement. These requirements are not optional and we apply them to every transaction.

7. Photographs and Content You Submit

You keep ownership of the photographs you send us. By sending them, you grant us a limited, non-exclusive license to use them for the purpose of evaluating and authenticating your item, communicating with you about it, and maintaining our business and legal records.

We will not use your photographs in advertising, on social media, or on this website without your separate written permission, unless we have purchased the item and it has become our property.

Do not submit content that is unlawful, infringing, or that you do not have the right to send.

8. Text Messaging Terms

8.1 The Program

If you check the SMS consent box on our valuation request form, or tell us in person or by phone that you would like to be contacted by text, you agree to receive text messages from Antwerp Diamonds at the mobile number you provide, including messages sent using automated technology.

The program sends confirmation of your valuation request and follow-up messages from our team about your item, your valuation, or your appointment. We do not send promotional or marketing text messages, and we do not send text messages soliciting loans.

8.2 Consent Is Optional

Consent to receive text messages is not a condition of any purchase, sale, valuation, loan, or other service. You can decline text messages and still submit a valuation request, and we will contact you by phone instead.

8.3 Frequency and Cost

Message frequency varies based on your activity and your conversation with our team. Message and data rates may apply. Your mobile carrier’s standard rates apply to every message you send and receive.

8.4 Opting Out and Getting Help

Reply STOP to any message to cancel. You will receive one confirmation message and then no further texts.

8.5 Carriers and Delivery

Carriers are not liable for delayed or undelivered messages. We cannot guarantee that any message will be delivered. Supported carriers may change without notice.

8.6 Changing Your Number

If you give up or change your mobile number, you agree to tell us promptly so we do not send messages intended for you to someone else.

8.7 Conversations with Our Team

Once a member of our team begins texting you, you are in a direct conversation with that person from a business phone. Ordinary carrier rates apply. Replying STOP in that conversation stops messages from our automated program; to stop messages from a staff member, simply tell them.

9. Loans and Pawn Transactions

Loan and pawn transactions are governed by a separate written agreement signed at the time of the transaction, and by the pawnbroker and lending laws of the state where the transaction takes place. Nothing on this website is a loan offer, a solicitation, an approval, or a commitment to lend. These Terms do not modify any loan agreement you sign with us.

10. Insured Shipping

If you choose to sell remotely, we will provide shipping instructions and insurance terms at that time. Those terms govern the shipment. Do not ship an item to us without first arranging it with our team, and never ship an item without the coverage we arrange.

11. Intellectual Property

All content on this website, including text, graphics, logos, photographs of our inventory, and layout, is owned by Antwerp Diamonds or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, scrape, or republish it without our written permission.

12. Trademarks of Other Brands

Antwerp Diamonds is not affiliated with, authorized by, endorsed by, or in any way officially connected to Rolex, Patek Philippe, Audemars Piguet, Cartier, Hermès, Chanel, Louis Vuitton, or any other brand, trademark, trade name, or proprietary name mentioned or displayed on this website. All brand names and trademarks are the property of their respective owners and are used only to describe items we buy and sell.

13. Prohibited Uses

You may not use this website to:

Submit false, misleading, or fraudulent information
Offer stolen, counterfeit, or unlawfully obtained goods
Harass our staff or other users
Scrape, mine, or harvest data
Introduce malware or attempt to gain unauthorized access to our systems
Violate any applicable law

14. Disclaimers

This website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or secure, or that any preliminary estimate will match a final offer.

Nothing on this site is investment, financial, tax, or legal advice. Precious metals and luxury goods markets fluctuate, and past prices we have paid do not predict future prices.

15. Limitation of Liability

To the fullest extent permitted by law, Antwerp Diamonds and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any lost profits or lost data, arising from your use of this website, from any preliminary estimate, or from any text message, whether based on contract, tort, or any other theory, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from your use of this website will not exceed one hundred U.S. dollars ($100.00). This limitation does not apply to a completed transaction, which is governed by the terms of that transaction.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Antwerp Diamonds and its owners, officers, employees, and agents from any claim, loss, liability, or expense, including reasonable attorneys’ fees, arising from your breach of these Terms, your submission of false information, or your presentation of an item you did not have the right to sell.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Any dispute arising from these Terms or your use of this website will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to their jurisdiction.

This section governs your use of the website. Transactions completed at our Las Vegas, Fort Lauderdale, or Houston offices are additionally subject to the laws of the state where the transaction took place.

18. Severability and Waiver

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it.

19. Changes to These Terms

We may update these Terms at any time. We will revise the “Last Updated” date above when we do. Your continued use of the website after a change means you accept the updated Terms.
